1. Personal data

  • 1.1 PUBLI-ART SHIRT (hereinafter: PAS), located at 2100 Deurne (Antwerp), Bisschoppenhoflaan 571-573, and with company number BE0435.627.988, is the data controller for the personal data we collect as outlined in this privacy policy.
  • 1.2 PAS is committed to protecting the privacy of its customers, and where we process your personal data, we do so in compliance with the provisions of the General Data Protection Regulation of April 27, 2016, and the Belgian Law of December 8, 1992, on the protection of privacy with regard to the processing of personal data.
    This privacy statement describes the various measures taken to protect your privacy during the use of our websites and/or services/products, and the rights you have in this regard as a user and/or customer.
    You are kindly invited to read this privacy statement carefully and to take note of its contents. Future adjustments are not excluded. We therefore ask you to regularly review this privacy statement to stay informed about any updates.
  • 1.3 Should you have any questions, concerns, or complaints about this privacy policy or the way we handle your personal data, or if you wish to submit a request to exercise your rights as outlined in Article 5 of this privacy policy, you can contact us through:
    a) Sending a letter by post to the aforementioned address, attention to our Privacy Officer [Nicolas Debbaut].
    b) Sending an email to our Privacy Officer at the designated email address: [liesa@pasprint.be].
    Your request will be processed within one month of receipt. If the complexity of your request prevents this, the period will be extended to two months. The decision to extend the period will be communicated to you within one month.
    If PAS is completely unable to comply with your request, this will also be communicated to you within one month of receipt. 2. Why are your personal data processed?

  • 2.1 Personal data refers to any information relating to an identified or identifiable natural person. Identifiable refers to identification data (such as name, ID number, location data, address, IP address, subscriptions, etc.) that can be used to identify you directly or indirectly.
  • 2.2 The personal data collected by PAS is gathered and used for the purposes and legal grounds listed below:
    a) Information collected about you is used to provide you with the desired service and to optimize this service for you. Processing is, where applicable, based on legitimate interest.
    b) You, as a customer, use the services of PAS, which means your personal data is processed in the context of the execution of an agreement.
    c) For advertising purposes, so that PAS can keep you informed about, among other things, promotions, activities, expenditures, offers, etc. Your data is processed, where applicable, based on legitimate interest.
    d) In the context of customer relationships, your data can be processed by PAS based on legitimate interest.
  • 2.3 To achieve the objectives outlined in article 2.3, PAS collects and processes your personal data. The processing concerns personal data that you have provided to PAS.
  • 2.4 If you have not reached the age of 16, your personal data will only be processed once PAS has received written consent or authorization to consent from your parent/legal guardian. However, if you are a minor but have reached the age of 16, you will need to provide written consent.
  • 2.5 If the legal basis for processing your personal data is consent, you will always have the right to withdraw your consent. This will not affect the lawfulness of the data processing carried out before the withdrawal of your consent. However, please be aware that upon withdrawal of your consent, you will no longer be able to use PAS services.

3. To whom does PAS disclose your personal data?

  • 3.1 The personal data that PAS processes will not be disclosed to anyone outside of PAS. Your data will be handled internally in accordance with the relevant provisions of the Law of December 8, 1992, on the protection of privacy with respect to the processing of personal data and the General Data Protection Regulation (GDPR).

4. How long will your data be retained?

  • 4.1 Your personal data will not be retained longer than necessary for the specific purpose.
  • 4.2 Personal data used by PAS for the provision of services to you or your services to PAS will be stored, retained, and used for as long as necessary to provide/enjoy the services. The data will be kept for a maximum of 1 year after the last use.
  • 4.3 Personal data used by PAS for direct marketing, as outlined in art. 2.2, c), will be stored, retained, and used for as long as PAS believes you will benefit from its messages. The data will be kept for a maximum of 1 year after the last use.
  • 4.4 Usage data will be stored and retained as long as such data is useful for supporting the website. The data will be deleted at least 5 years after the last use.
  • 4.5 If you withdraw your consent or object to PAS’s use of your personal data, and such an objection is valid, PAS will remove your personal data from its databases.
  • 4.6 However, the above will not prevent PAS from retaining information and content for legal purposes such as, but not limited to, the exercise or defense of a legal claim, evidentiary purposes, backup, administration, and the fulfillment of other legal rights and obligations that PAS is subject to.

5. What are your rights?

  • 5.1 This section outlines your primary rights as set forth in the General Data Protection Regulation (GDPR).
  • 5.2 If you wish to exercise your rights, please send PAS a written request in accordance with Article 1.3 of this privacy policy. PAS will respond to your request within one month. If an extension is required to respond to your request, or if PAS does not take action on your request, PAS will inform you of this. In such a case, you have the right to file a complaint with the Data Protection Authority.
  • 5.3 You have the right to request access to your personal data at any time. You have the right to receive a copy of the personal data PAS holds about you, provided this does not negatively impact the rights and freedoms of others. The first copy will be provided for free, but PAS reserves the right to charge a reasonable fee if you request additional copies.
  • 5.4 If the personal data PAS holds about you is inaccurate or incomplete, you have the right to rectify this information or, considering the purposes of the processing, complete it.
  • 5.5 If any of the following conditions are met, you have the right to have your personal data erased without undue delay:
    a) The personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
    b) You withdraw your consent and no other legal grounds exist;
    c) The personal data has been processed unlawfully;
    d) You object and there is no overriding legitimate ground for processing;
    e) The erasure of data is required for compliance with EU or Belgian law.
  • 5.6 However, there are exceptions to the right to erasure. These exceptions include cases where processing is necessary:
    a) For the exercise of the right to freedom of expression and information;
    b) To comply with a legal obligation;
    c) For the establishment, exercise, or defense of legal claims.
  • 5.7 You have the right to request that the processing of your personal data be restricted if one of the following conditions is met:
    a) You contest the accuracy of the data (and only for as long as it takes to verify the accuracy);
    b) The processing is unlawful and you request restriction (instead of exercising the right to erasure);
    c) PAS no longer needs the personal data for processing, but your personal data is required for the establishment, exercise, or defense of legal claims;
    d) You have objected to the processing, pending verification of that objection.
  • 5.8 In addition to the right to store personal data, PAS also has the right to process your personal data in other ways, but only:
    a) With your consent;
    b) For the establishment, exercise, or defense of legal claims;
    c) To protect the rights of another natural or legal person;
    d) For reasons of substantial public interest.
  • 5.9 PAS will inform you in any case before lifting the restriction on the processing of data.
  • 5.10 If your consent is the legal basis for the processing of your personal data and such processing is automated, you have the right to receive your personal data from PAS in a structured, commonly used, and machine-readable format. However, this right does not apply when it would adversely affect the rights and freedoms of others.
  • 5.11 You also have the right to have your personal data transferred directly to another organization, where technically feasible, and/or to store your personal data on your own device for further personal use.
  • 5.12 You have the right to object at any time to the processing of your personal data based on your specific situation, but only insofar as consent is the legal basis for processing and the processing is necessary for:
    a) The performance of a task carried out in the public interest or in the exercise of official authority vested in PAS;
    b) Legitimate interests pursued by PAS or a third party.
  • 5.13 If you make such an objection, PAS will stop processing your personal data unless PAS can demonstrate compelling legitimate grounds for processing, which override your interests, rights, and freedoms, or if the processing is necessary for the establishment, exercise, or defense of legal claims.
  • 5.14 You have the right to object to the processing of your personal data for direct marketing purposes (including for direct marketing purposes). If you make such an objection, PAS will stop processing your data for this purpose.
  • 5.15 If you believe that PAS’s processing of your data constitutes a breach of the General Data Protection Regulation (GDPR), you have the legal right to lodge a complaint with the Data Protection Authority. You can do this in the EU member state of your habitual residence, place of work, or the place where the alleged violation took place. In Belgium, you can file a complaint with the Data Protection Authority at Drukpersstraat 35, 1000 Brussels.

  • 6.1 PAS is committed to maintaining the confidentiality of your personal data and has taken security measures to prevent any potential loss, misuse, or alteration of this data.

7. Various provisions regarding services

  • 7.1 PAS accepts no liability for errors or omissions published on this website and web catalog.
  • 7.2 Technical changes may occur as products are continuously being improved.
  • 7.3 The sizes of clothing items in the web catalog are approximate and serve only as an indication. These sizes may vary depending on the supplier.
  • 7.4 All indications of clothing weight in the web catalog are subject to standard tolerances.
  • 7.5 All products are subject to availability.
  • 7.6 Due to technical reasons, color variations may occur during the textile production process.
  • 7.7 Color representation is as accurate as the display of the computer screen allows.
